Doxey Fights Attempt to Block His Salvage Business

City is asking for an order to prevent Doxey from doing business in Glen Cove until his trial is finished.

The man  for allegedly dumping hazardous waste in his salvage yard appeared in Glen Cove City Court Thursday to fight a temporary restraining order the city is attempting to file against his business.

The order would prevent John Doxey’s business from operating or gaining any profit for the duration of his trial. The prosecuting attorneys are trying to obtain the restraining order by showing that the area is too hazardous to the community.

One witness said he observed fluids leaking from containers on the back of the accused’s flatbed truck every time he went to the salvage yard at 4 Park Place, and that prior to obtaining the search warrant he had never seen a company there who was licensed to remove hazardous wastes at the site.

Michael Zarin, an attorney for the City of Glen Cove, said he was confidant the order would be obtained.

“Salvage yards are not allowed in that zoning area,” he said. “And even if they were, everything they’re doing – the chopping operation, the fluids being discharged – is illegal.”

Court sessions for the order will continue into next week.

Appearance dates for the original charges have yet to be set.
